- 1. Agreement to Terms and Conditions
- 1.1 These Terms and Conditions constitute a legally-binding agreement made between you, whether personally or on behalf of an entity (you) and Tessa Manning Yoga (referred to in these terms as “TMY” – the words “we”, “us”, “our” and similar words also refer to “TMY”), concerning any Retreat purchased from TMY.
1.2 You agree that by attending a Retreat, you have read, understood, and agree to be bound by these Terms and Conditions.
1.3 Because we can change these Terms and Conditions from time to time, we do recommend that you print off a copy and keep them safe. The updated version of these Terms and Conditions will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. You are responsible for reviewing these Terms and Conditions to stay informed of updates.
1.4 We want and expect you to be delighted with any Retreat purchased from TMY. If you have any complaints, please email us at [email protected] and give us the chance to investigate and, if relevant, try to put things right for you. - 2. Eligibility
- 2.1 To be eligible to purchase and/ or attend a Retreat from TMY you must be 18 years of age or over.
2.2 If you are booking a Retreat from TMY, you must:
a. provide your real name, phone number, email address, and other requested information
b. understand that by giving your deposit, you are agreeing to these terms and conditions
c. secure the booking by paying the non-refundable deposit - 3. Prices and Payment
- 3.1 The prices for Retreats from TMY will be shown on our Website. We use our best efforts to ensure that the prices of Retreats are correct at the time of being uploaded to the Website. If we discover an error in the price of any Retreat you booked, please see clause 3.2 below for what happens.
3.2 Although we will endeavor to ensure that all information on our Website is accurate, occasionally errors may occur. This is what happens if we discover an error:
a. If we discover an error in the description of a Retreat that you have booked, we will let you know and ask whether you wish to continue with your booking or cancel it.
b. Where the Website showed a price which was too high, we will charge the lower amount when confirming the booking to you with a Confirmation Email.
c. Where the Website showed a price which was too low, and the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mis-pricing, we do not have to provide the Retreat to you at the incorrect (lower) price. We will contact you as soon as possible to inform you of this error and we will give you the option of continuing to purchase the Retreat at the correct (higher) price or cancelling your order. We will not process your booking until we have your instructions. If we are unable to contact you using the contact details you provided during the booking process, we will treat the booking as cancelled and notify you in writing.
3.3 Prices for the Retreat(s) may change from time to time, but changes will not affect any booking which we have already confirmed with a Confirmation Email.
3.4 We currently accept payment for Retreats by Venmo, Check, Cash or CC.
3.5 If we are unable to supply the Retreat, we will let you know as soon as possible. We will give you a full refund if we have already taken payment for a Retreat that we can no longer supply.
3.6 Full payment for the Retreat is 12 weeks in advance of the specific Retreat you wish to attend, unless otherwise stated. Late payment (without prior written consent) will result in you losing your booked space on the Retreat and any monies previously paid being lost. - 4. Exclusion and Limitation of Liability
- 4.1 There are certain liabilities which we cannot exclude by law and nothing in our contract with you excludes or limits our liability for the following things:
a. death or personal injury caused by our negligence;
b. fraud or fraudulent misrepresentation; or
c. any other thing for which we are not legally allowed to limit (or try to limit) our liability or obligations to you.
4.2 You have certain rights as a consumer, including legal rights relating to Retreats that are faulty or not as described. Our terms already reflect those legal rights and nothing in our contract with you will reduce them. For further information about your legal rights, please contact your local authority Trading Standards Department or Citizens Advice.
4.3 We will not be responsible or liable for:
a. any losses related to any business of yours, including loss of data, profits, revenue, business, opportunity, goodwill or reputation, or business interruption; or
b. any losses which were not something we could have reasonably expected (as consequences of us doing anything wrong under our contract with you) when entering into that contract.
4.4 We will not be in breach of our obligations under our contract with you if we are prevented or delayed from complying with those obligations by:
a. anything you (or anyone acting on your behalf) does or fails to do; or
b. events or circumstances beyond our reasonable control (including fire, flood, extreme weather, bio-emergencies, strikes, trade disputes, lock-outs, restrictions of imports or exports, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war). - 5. Legal Matters
- 5.1 When you purchase a Retreat from TMY, you provide personal details, both for yourself and, if relevant, for other members of your group. By entering personal details for your group members (if any), you are promising (in legal terms, you are warranting) to us that you have their consent to do that.
5.2 Some laws require that certain information or communications we send to you should be in writing. You agree that communicating with you by email, text message, notices on our Website or other text-based electronic methods counts as communicating with you in writing.
5.3 If any part of our contract with you is found to be unenforceable as a matter of law, all other parts of that contract are unaffected and will remain in force.
5.4 Any contract we form with you is personal to you. You may not assign, sub-license or otherwise transfer any of your rights under that contract.
5.5 Nobody apart from us and the buyer of a Retreat has any rights under this contract. - 6. Specific Terms and Conditions for Retreats
- 6.1. We must receive payment in full by the date specified on the Website for the specific Retreat you and all members of your party wish to attend. Failure to pay by the date specified, will result in you being taken off the Retreat and losing any monies already paid.
6.2 Cancellations made less than 12 weeks before the start date of the Retreat, will lose all monies previously paid.
6.3 We will be entitled to require you to leave a Retreat if in our reasonable opinion you behave in an unacceptable manner. In this case, you will not be refunded for any monies paid.
6.4 Your deposit is non refundable
6.6 You are advised not to bring any items of special or high value onto our Retreats. We do not accept responsibility for damage to or the loss of any personal possessions. - 7. Our Rights to Cancel or Reschedule
- 7.1 We may cancel any Retreat due to events or circumstances outside our reasonable control OR teacher subject to change under certain circumstances
7.2 Although it is rare for us to do so, we may also reschedule any Retreat at any time. We may also change the location or content of any Retreat and/or substitute the instructor (s) for a Retreat for another at any time.
7.3 If we do cancel, reschedule or make any changes as described in clauses 7.1 and 7.2 above, we will notify you by telephone or by email and will endeavor to do so as soon as possible after making those changes. - 8. Your Right to Cancel
- 8.1 Our Retreats all involve accommodation, food and yoga-related services and we hold them on specific dates. The Cancellation Policy for TMY Retreats is as follows: Cancel with full reimbursement (minus deposit) 17 weeks in advance. After which, no refund given. Although we will try our best to accommodate you.
8.2 In certain circumstances we permit you to transfer your booking to friends and family members if:
a. you notify us in writing at least 14 days before the start of the Retreat;
b. you provide the name and contact details of the person who will be taking your place;
c. the person taking your place accepts the same accommodation in your original booking and fulfills the eligibility criteria as set out in clauses 2.1 and 2.2 above, and
d. a $25 administration fee is received for making that transfer.
8.3 Failure to attend a Retreat without prior notification of cancellation in writing and in accordance with the terms of the Cancellation Policy for the specific Retreat will result in a loss of any monies paid.
8.4 We strongly recommend that you obtain appropriate travel insurance prior to placing a booking for any Retreat to cover you in the event that you cannot attend a Retreat for unforeseen reasons, for example due to bad weather, transport delays or cancellations, illness or bereavement. Some banks automatically provide you with travel insurance cover – please check with your relevant insurance services provider(s) before booking with us.
